Justice Department sues over Arizona immigration law

I confess, I’m conflicted. It’s a bad law. It should go. This is a good decision on the part of the Justice Dept. In Sacramento, the City Council voted recently to ban trade with Arizona until the immigration law is gone. While I had personally planned to order some rain barrels from an Arizona firm, in light of Sacramento’s decision, I determined to hold off. Yet, I take the point that reform should be top priority and that states do have some rights of their own. It would be lovely to think this court battle could wind up being a back door approach to reform. I think however, that is an overly optimistic attitude. Take the time and refresh your memory of Tom Barry’s take on the Federal Government’s/Obama’s involvement to date. It’s always layers upon layers.

it a loose loose situation . if the feds over turn this law claiming it unconstitutional the it sets a sets a precedents the the Federal gov can come into state an overturn or state laws such as Texas capital punishment for iv herd the same thing said about death penalty as the things said about the AZ law. i have no problem with the AZ law . just as i have no prob with capital punishment/
if the feds win this case you can expect a flood of illegals like never before . if the feds loose every RED state that considering passing a similar law will do so knowing that it can not be overturned by the feds. my city also passed a resolution condemning the AZ law in my opinion its none of the city of San Antonio’s business an inappropriate taking a stand another states laws one way or the other.

Boogie – if the law is overturned things will as they were before the law was enacted. The “flood” of illegals will be no different then it was before the Arizona law was enacted, and as it is now, because they are not yet enforcing it.
There are records of many, many court fights down through the years between the States and the Federal Government. Sometimes the States win and sometimes the Feds do. There is no precedent to be set.
There are questions about whether the law can be fairly enacted because it will racially profile people and may promote stopping people in the streets and arresting them for no other reason than that they are Hispanic or speak another language.
Another point is that it will require a legal division of time for local officers to participate in immigration arrests and limit time for other normal work, such as violent crime, property crimes home invasion, rape, abuse and child endangerment.
However, if the law is overturned it will be because the Courts have determined that Arizona has overreached it’s rights as a state.
